Enter to Win Contest
1. Eligibility: The “Holiday Giveaway" is open to residents of California. Notwithstanding the foregoing, the Contest is not open to employees, representatives and agents of Pico Rivera Towne Center, or Pico Rivera Towne Center merchants or any retailer located in Pico Rivera Towne Center or the Contest Sponsors’ affiliated companies, advertising and promotional agencies or members of their respective immediate families, and all persons with whom any of the foregoing are domiciled. By entering this Contest, entrants are deemed to have accepted and be bound by the rules set out herein (the “Contest Rules”), which are subject to change without notice, and all entrants automatically release and hold harmless the Contest Sponsors, their advertising and promotional agencies, their affiliates and respective directors, officers, owners, partners, employees, agents, dealers, representatives, successors and assigns from any liability in connection with this Contest, including, without limitation, the selection of winners and administration of the Contest, or, if declared a winner, the prize.
2. Entry: To enter, participants must visit https://shoppico.com/contest/holidaygiveaway2024 and complete the entry ballot on the website between December 2, 2024, to December 31, 2024. Each ballot successfully submitted during the Contest Period (as defined below) will count as one (1) entry in the Contest. A potential prize winner may only enter the contest once. Multiple entries will result in disqualification from the contest.
3. Prizes: Prize details can be found on the contest ballot and/or advertising. The prizes are not redeemable for cash. Prizes must be accepted as awarded and may not be transferred or exchanged or combined or used in concert with another contest or another offer. The Contest Sponsors reserve the right to substitute a prize (or prize component) of approximately the same retail value in the event of the unavailability, for whatever reason, of the advertised prize (or prize component) in the Contest Sponsors’ sole and absolute discretion without prior notice. Except as expressly represented or warranted herein, the prize is provided to the winner “as is” without any additional or further representation or warranty of any kind. All taxes, fees, surcharges and other charges on the prize, if any, are the sole responsibility of the prize winner.
4. General Terms and Conditions:
a. The Contest begins on December 2, 2024 and ends at 11:59 PM PST on December 31, 2024 (the “Contest Period”). All times refer to Pacific Standard Time (“PST”).
b. One (1) winning entry will be selected for the grand prize. The potential prize winner will be selected by a random draw on or around January 1, 2024. The potential prize winner will be contacted via email at the address provided within two (2) business days of selecting the potential prize winner. Each potential prize winner must satisfy all Contest Rules in order to qualify to receive the prize. Although online access is required in order to participate, no purchase is necessary to enter the Contest.
c. If a potential prize winner cannot be reached within two (2) business days following the selection, declines the prize, or does not claim the prize within 48 hours of email notification, then the prize initially awarded to the selected entrant may be forfeited without any liability to the Contest Sponsors and another entrant may be selected. The Contest Sponsors reserve the right to verify that the potential prize winner satisfies all Contest Rules, including providing the Contest Sponsors with a government issued photo identification as evidence of their age.
d. Odds of winning depend on the number of eligible entries received during the Contest Period. All entries are subject to verification and any entries that are incomplete, illegible, damaged, destroyed, irregular, erroneous, inappropriate, incorrectly addressed, misdirected, that have been submitted through illicit means, or do not conform to or satisfy any condition of the Contest Rules may be disqualified by the Contest Sponsors in their sole and absolute discretion. The Contest Sponsors take no responsibility for lost, delayed, misdirected or late entries. The Contest Sponsors are not responsible for any errors or omissions in printing or advertising this Contest. All entries become the sole and exclusive property of the Contest Sponsors and will not be returned.
e. By entering this Contest and voluntarily providing personal information including, but not limited to, the entrant’s first and last name, and e-mail address each entrant automatically grants permission to the Contest Sponsors and their respective advertising and promotional agencies for the collection and use of such information for the exclusive purpose of administering the Contest and selecting the winners of the prizes. Any entrant who has voluntarily indicated on the entry form that he/she wishes to be contacted regarding future promotions and/or offers and has granted permission to do so, will be added to the Contest Sponsors’ e-mail database. No further informational or marketing communications will be collected from entrants unless entrants provide the Contest Sponsors with explicit permission to do so as indicated on the entry form. f. Before being declared a winner, entrants may be required to sign and return, within a stipulated period of time, a declaration of compliance with the Contest Rules and acceptance of the prize as awarded and a full liability and publicity Release in favour of the Contest Sponsors. By accepting a prize, each entrant automatically consents to the use, disclosure and publication of their name, city of residence, voice, statements, photographs, image or other likenesses for publicity, advertising or informational purposes by the Contest Sponsors and their respective advertising and promotional agencies in any medium or format without payment, compensation or notice.
g. This Contest will be run in accordance with these Contest Rules, subject to amendment from time to time by the Contest Sponsors. Contestants must comply with these Contest Rules and will be deemed to have received and understood the Contest Rules by participating in the Contest. The terms and conditions of this Contest, as set out in these Contest Rules, are not subject to counter-offer or amendment by an entrant (or their parent/legal guardian), except as expressly set out herein.
h. Any dispute relating to the Contest, including, without limitation, a dispute as to whether an entrant has complied with all of the Contest Rules, shall be resolved by the Contest Sponsors in their sole and absolute discretion. All decisions of the Contest Sponsors and/or the contest judge appointed by the Contest Sponsors regarding any and all aspects of the Contest shall be final and binding without any right of appeal or review.
i. The Contest Sponsors are not responsible or liable, jointly or severally, for any of the following: (i) failure of the internet or the website during the Contest Period including, without limitation, the failure for any reason whatsoever of selected entrants to receive a prize notification, (b) for any problems or technical malfunction of any telephone network or lines, computer online systems, servers, access providers, computer equipment, software, failure of any e-mail or traffic congestion on the internet or at any website, or any combination thereof including, without limitation, the failure of any entry or prize claim to be received by the Contest Sponsors or any injury or damage to an entrant’s or any other person’s computer related to or resulting from playing or downloading any material in the Contest, (iii) change in entrants’ telephone numbers or e-mail address after entries are submitted, (iv) damage or loss, including any loss, loss of productions, loss of profits
(anticipated or otherwise), economic loss, special, indirect or consequential loss or damage or punitive damages, whether in contract, tort or under any other theory of law or equity, arising from, connected with, or relating to the Contest, the submission of entries to the Contest, or participation in the Contest, or the prize and regardless of the cause or any negligence by any of the Contest Sponsors or any person or entity for whom any of them are responsible, and notwithstanding that any of those entities or persons may have been advised of the possibility of such loss or damage being incurred.
j. The Contest Sponsors reserve the right, in their sole and absolute discretion, to suspend, delay or terminate the Contest should a virus, bug, tampering, unauthorized intervention, fraud, technical failure, or any other cause beyond their reasonable control corrupt, compromise or interfere with the administration, security, fairness, integrity or proper conduct and administration of the Contest, and the Contest Sponsors may disqualify any entrant responsible for such misconduct. Any attempt to deliberately damage any website or to undermine the legitimate operation of this Contest is a violation of criminal and civil laws. Should such an attempt be made, the Contest Sponsors reserve the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution.
k. This Contest is void where prohibited by law and is subject to all applicable laws and regulations. If any provision of these Contest Rules is found by any court of competent jurisdiction to be unenforceable, all other provisions will remain in full force and effect.
l. This Contest and all related matters are governed solely by laws of California, United States and applicable federal laws of United States. Proceedings regarding any dispute must be commenced in a court of competent jurisdiction in California, United States within six (6) months after the dispute arose, after which time any and all proceedings regarding the dispute are barred.
